Contents of Dan's AOS package

If you read about how we put together our I-129F, you will notice that the AOS application was constructed in much the same manner...

  • money orders for $220 (AOS), $100 (EAD), and $25 (fingerprinting) paperclipped to

  • FC-029 statement about truth and accuracy of photocopies

How Dan's AOS package was put together

  • Everything was 2 hole punched at the top and fastened with an ACCO prong fastener ACCO fastener
  • It was divided into 6 tabbed sections
    • I-485
    • I-864 (Sponsor)
    • I-864 (Joint Sponsor)
    • I-765
    • G-325A
    • Supporting Documentation
  • Again we used the same medium card stock purchased for the I-129F with Avery Peel & Stick Index Tabs stuck on the bottoms for the dividers. This time the tab titles were printed on card stock, rather than being typed or handwritten.
  • The cover letter was the topmost piece of paper (before the first tab), and the money orders were paperclipped to it.
  • The G-325A photographs were attached to the forms by putting them in clear snack-sized plastic bags paper-clipped to the forms.
  • Labels were printed out (Avery 5160 White Address Lbels) with Dan's name, the date, "I-485 ORIGINAL SUBMISSION", and then signed by Dan. These labels were fixed to every page other than the INS forms and the cover letter.
  • Becky also made a backup copy of this exactly like the original, except for the labels.

 
How the AOS package was mailed

  • This was mailed in a 9" x 12" envelope
  • It was sent USPS Priority Mail with Tracking.
  • We wrote "I-485 ORIGINAL SUBMISSION" on the envelope

 
The I-485 form

Part 1 is, as usual, straightforward. Under "Current INS Status" we put "K-1."

In Part 2 we checked "c. I entered as a K-1 fiancé(e) of a U.S. citizen ..."

Part 3 (a) asks more information about the petitioner (foreign spouse). Under "In what status did you laste enter?" we put "K-1 Visa Holder". The "Nonimmigrant Visa Number" is the red number on the bottom right of the K-1 Visa. (Should be on same line as the A# - THIS IS NOT THE SAME THING AS YOUR A#!)

In Part 3 (b) we listed Becky as the only family member, where it asks "Applying with You?" we ticked "No."

Part 3 (c): NONE (Although, if you were a member of a political organization, military, etc. and so forth, you should put it down.)

Part 3 - that long list. Dan's answer was "no" for all of the questions. (If your answer should be "Yes," then you should probably check "Yes" and explain on another sheet of paper.)

 
I-765 Application for Employment Authorization

The I-765 is another straightforward form. Question 14, Manner of Last Entry was "K-1 Fiance Visa Holder." Question 15, Current Immigration Status is "Pending Adjustment of Status. " For question 16, K-1 AOS applicants are eligible under (c)(9) Adjustment Applicant. Just fill out the info (name, DOB, A#, etc.) and sign

Because this was submitted with Dan's I-485, the only evidence we attached directly behind the I-765 was a copy of his K-1 visa and front and back of his I-94.

 
G-325A Revisited
We also discussed the G-325A as sent with the I-129F

This time around we used the fillable PDF version and printed each page out on the appropriately colored piece of paper. It was much easier this way because all of the information actually fit into those little boxes. So we updated his residency and employment information, and this time we checked the "STATUS AS PERMANENT RESIDENT" box under "THIS FORM IS SUBMITTED IN CONNECTION WITH APPLICATION FOR" section.

ADIT photos were again put into a snack-sized plastic bag paperclipped to the G-325A.
